In this article Aoife Muckian discusses the issues associated with mandatory reporting of child abuse and the access to therapy when disclosing historical child abuse in light of McGrath v HSE [2023] IECA 293 and potential uncertainty in the state of the law as a result. She considers what legislative change could be required to ensure survivors can access the benefit of therapy.
